In accordance with Article 1, paragraph 4, of the Convention, the Republic of Finland declares to specify the following categories of family cases to which this Convention is to apply before its judicial authorities: establishment of paternity, adoption and proceedings concerning the taking of a child into care.

Convention européenne sur l’exercice des droits des enfants

La Convention vise la protection du bien-être de l’enfant en contenant différentes mesures concernant ses droits procéduraux et en facilitant l’exercice. Elle date du 25 janvier 1996 (Entrée en vigueur: 1er juillet 2000)

C'est surtout en cas de procédure judiciaire familiale (en particulier en ce qui concerne la garde, la résidence, le droit de visite, l’adoption, la tutelle, l’administration des biens, la déchéance ou la limitation de l’autorité parentale, la protection contre des traitements cruels et dégradants, les traitements médicaux), que le droit de l’enfant à l’information ainsi que le droit de s’exprimer doivent être garantis, et l’enfant peut exercer son droit lui-même, soit par l’intermédiaire d’autres personnes ou organes. Chaque Etat doit désigner au minimum 3 catégories de litiges familiaux auxquels la Convention s’applique.

Pour la surveillance de l’application de la Convention, celle-ci prévoit la mise en place d’un Comité permanent.

Bien que la Convention soit explicitement en relation avec la Convention internationale des droits de l’enfant de l’ONU de 1989, et formule le but de contribuer à sa mise en oeuvre, elle a été critiquée et considérée comme se situant derrière le standard de l’ONU, qui prévoit notamment dans son article 12 un droit large. Le fait que la Convention prévoit la possiblité de limiter la reconnaissance de la Convention à trois procédures apporte peu de clarté dans ce domaine. La Convention a été ratifiée jusqu’à maintenant par 18 Etats européen (état au 12 mai 2014; le nombre actuel se trouve dans la liste complète des traités du conseil de l’Europe sous le numéro 160).
